If one artist paints an apple, does that mean that all the other artists cant panit an apple? As long as you are not selling it as being a painting of mine, you should be free to paint as many apples as you like. I have been to court for suposedly copying someone elses work. The judge looked at the case, laughed and through it out using the apple painting as an example.
You are not copying anyone. Keep up the good work.

Here's my thinking.

Subject : Apple
Technique : Method used to make apple (i.e. glass solid mass, hollow..etc. etc)
Design : The way you make your apple stick out from the rest.

I wonder who owns the copywright of melting glass to make an apple? Am I allowed to put a glass rod in a fire to change the shape of the glass? I wonder if Chevy has ever sued Ford for using the same technique to produce car bumpers? I still hold to the idea that as long as you are not selling something claiming it to be one of mine, you are free to make as many as you like.

Design however is totally differant. A straight like that is exactly 2 inches long is a totally differant design from one that is 2.1 inches long. As an artist you own the design of your work because no matter how hard you try you will not be able to make another one just exactly like it. Much less to seperate artists making exactly the same item.
